Terms of Service

1. Who may use the Service

The Service is intended for business use by commercial real estate professionals and the people who work with them. You must have reached the age of majority where you live. If you use the Service for an organization, you confirm you are authorized to accept these Terms on its behalf, and “you” includes that organization.

2. Your account

Keep your sign-in details confidential and accurate. You are responsible for activity under your account. Tell us promptly if you believe your account has been used without permission.

3. The Service

The Service helps you prepare marketing documents for commercial real estate, such as teasers, brochures and offering memoranda, from information you provide and from third-party data sources. We may add, change or remove features. If a change materially reduces a paid feature you have already paid for, we will tell you in advance.

4. Free preview

Each account may generate one free preview. The preview is shown as watermarked page images on screen; it does not include a downloadable file. We may limit or withdraw the free preview where we reasonably believe it is being misused, for example through multiple accounts.

5. Purchases and subscriptions

• A one-time purchase gives you the right to download the clean PDF of one document in the output type you bought (for example, the brochure for one listing).
• A subscription gives you downloads of the output types included in your plan for as long as the subscription is active. Higher plans include smaller outputs.
• Prices are shown in Canadian dollars at checkout. Applicable taxes are added where required.
• Payments are processed by Square. We do not receive or store your full card number.
• Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel from your account page; cancellation takes effect at the end of the current period.
• If we change a subscription price, we will give you notice before the change applies to your next renewal.

6. Refunds

Refunds and cancellations are covered by our Refund & Cancellation Policy, which forms part of these Terms.

7. Your content

You keep ownership of the information, photos, plans, logos and other material you upload or enter (“Your Content”). You grant us a non-exclusive, worldwide licence to host, copy, process, transmit and display Your Content only as needed to provide and improve the Service, including sending it to the service providers described in our Privacy Policy.

You confirm that you have the rights and permissions needed for Your Content, including from photographers, brokerages and co-brand partners, and from any individuals whose names, photos or contact details appear in it.

8. Generated documents

Subject to these Terms and any required payment, you may use, copy and distribute the documents you generate to market the listings they describe. The software, templates, layouts and page designs remain ours. Sample pages on our website are produced from fictitious test data and may not be reused as your own.

9. AI-assisted and third-party content

Some features use artificial intelligence and third-party data, including fact extraction from your files, web research, drafted copy, image suggestions, maps, drive times and amenity counts. This content can be incomplete, out of date or wrong. It is labelled where it appears so that you can check it.

10. No professional advice

The Service is a document preparation tool. It does not provide legal, financial, investment, tax, valuation or appraisal advice, and nothing in a generated document is a representation by us about any property. Using the Service does not change your obligations as a real estate registrant under applicable law, for example Ontario’s Trust in Real Estate Services Act, 2002, including the rules on advertising and on representing material facts accurately.

11. Acceptable use

You must follow our Acceptable Use Policy, which forms part of these Terms.

12. Availability and changes

We work to keep the Service available but do not promise that it will be uninterrupted or error-free. We may suspend parts of it for maintenance, security or reasons outside our control.

13. Suspension and termination

You may stop using the Service at any time. We may suspend or close an account that breaches these Terms or that we reasonably believe puts the Service, other users or third parties at risk. Where practical we will give notice and a chance to download your documents first. Sections that by their nature should survive termination will survive.

14. Disclaimers

To the extent permitted by law, the Service and all generated content are provided “as is” and “as available”, without warranties of any kind, including fitness for a particular purpose, accuracy or non-infringement.

15. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, commissions, data or goodwill. Our total liability for all claims relating to the Service is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

16. Indemnity

You will indemnify us against claims, losses and costs (including reasonable legal fees) arising from Your Content, documents you distribute, or your breach of these Terms or of the law.

17. Changes to these Terms

We may update these Terms. If a change is material we will give reasonable notice, for example by email or in the app, before it takes effect. Continuing to use the Service after that date means you accept the updated Terms.

18. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Ontario have exclusive jurisdiction, except where consumer protection law gives you the right to bring a claim elsewhere.
